TERMS AND CONDITIONS
The below Terms & Conditions specifically and clearly interpret all terms and conditions for an agreement of tours & safari services between Breezy Tours & Travel and the clients. It is important that clients understand these with full acceptance before making a booking with us. Once a reservation with deposit is made, our contractual relationship is hereby set forth.
Prices
The tour price is in US dollar and quoted per person, based on double, twin or triple occupancy share basis, unless otherwise specified.
All tour costs are based upon the services mentioned in each tour’s detailed itinerary as per the Inclusions section. Services are offered as a complete dedicated package and Breezy Tours & Travel will not provide a breakdown of trip component costs (Any kind of unused parts or late show up…). All costs quoted are based on availability and subject to change without notice, as airlines and hotels can unexpectedly impose rate increases.
Transport
Transportations, transfers, excursions and tours shall be by our safari vehicles which included Microbuses, 4×4 Safari Land Cruiser, Safari vans and saloon cars. Internal flights will also be used depending on itinerary inclusions.
Payments
A deposit of 50% of total invoice is required in order to confirm all our services. Balance of payment is due not later than 45 days prior to your departure. Failure to pay by the due date may result in unexpected cancellation of the booking. Payment may be made by cash, telegraphic/electronic transfer or credit card (Visa, Master and American Express card). Except for the cash payment (at some special cases), any levied charges for the telegraphic/electronic transfer or any applied surcharges for credit card banking (3%) & online payment (5%) should be covered by the clients. Following full payment, final voucher of services and related documents will be forwarded by e-mail to clients at a maximum of two weeks prior to your home departure. Payment in full upon confirmation to our services is suggested to avoid the second banking transfer fee for the clients.
Safari Orientations
All our safaris are usually PRIVATE safaris unless the clients request for joining group safari in which case clients will share the safari facilities with others. Clients joining groups are therefore advised to be good-natured and enjoy being with others and be prepared to encounter customs and habits, which may be different from your own and forms part of the adventure.
Changes in Itineraries
The sequence of itineraries is normally adhered to but the company reserves the right to make alterations occasioned by weather, road works, high season congestion or any other unforeseen circumstances.
Cancellation Policy
In case a booking is cancelled the following cancellation fees shall apply:
• For the Premium Season (1 st July to 30 th September & 22 nd December to 5th January inclusive),
0-7 days 100% charge applies on the entire booking value
8-30 days 75% charge applies on the entire booking value
31-60 days 30% charge applies on the entire booking value
Above 60 days 15% charge applies on the entire booking value
• For the Other Season (1 st October to 21 st December & 6 th January to 30 th June inclusive),
0-7 days 100% charge applies on the entire booking value
8-14 days 75% charge applies on the entire booking value
15-30 days 30% charge applies on the entire booking value
Above 30 days 15% charge applies on the entire booking value
Liability
The company liability to passengers carried in vehicles for transfers, excursions and tours is governed by the laws of Kenya and all claims are subjected to the courts of Kenya. Whilst every care is taken, the company shall NOT be held liable for loss or damage to
personal property and clients are advised to arrange relevant insurance package that covers emergency medical evacuation, hospital costs and repatriation. The company has a deposit and clients are advised to deposit their valuables so that they do not suffer any
losses. It is highly recommended that you purchase Travel Insurance to protect your travel investment.
Claims
All disputes, claims and litigation regarding the Services shall first be settled by way of negotiation and mutual understanding. In the event such negotiation and mutual understanding come to failure, the disputes, claim or litigation shall be finally settled by arbitration of the Nairobi (Kenya) International Arbitration Centre. Claims must be submitted in writing within 30 days after the end of the services.
Sub-contract
The company reserves the right to sub-contract any part or the full safari and the event of such sub-contract all the above terms shall apply.
